The New Brunswick Court of Appeal has dismissed an application for judicial review of the province’s decision to build the new high school on the outskirts of the city.

The application, filed in July by four Moncton citizens, sought to challenge the government’s lack of consultation in selecting the Royal Oaks site and also argue that the decision to set up a school on the outskirts of the city violates the Community Planning Act.

Following a lower court ruling that upheld the citizen’s application, the province sought a ruling from the province’s highest court and on Wednesday, it unanimously granted the province’s wish to the have application thrown out.

A lawyer for the citizens group says she will have to see the court’s written decision before deciding where to go from here.
