MONCTON, NB -A fight over the location of a new Moncton High school continues to wind its way through the courts.

Despite an attempt by the province to stop it in its tracks, an application for a judicial review of plans to build a new high school on lands off Elmwood Drive will proceed as planned.

Four members of the group “Stop the Royal Hoax” want a judicial review of the Province’s plans.

They say the government failed to consult properly and that the location goes against Moncton’s municipal plan.

Lawyers for the province moved yesterday to have the application dismissed –  saying it comes too long after the education minister announced where the school would be located.

A lawyer representing the individuals who are seeking the review says it’s well within the time frame as pertinent information with regard to how the the decision was made only came to light in March.

The application for a judicial review is scheduled to be heard September 7th.
